COMMISSIONER’S SALE
NOTICE IS HEREBY GIVEN that pursuant to the authority and directions contained in the Judgment and Decree of Foreclosure entered on the 21st day of April, 2026, in case No. 08WCV-25-69 between ARVEST BANK, Plaintiff, and THE ESTATE OF LETA GIBSON, Deceased; THE UNKNOWN SPOUSE OF LETA GIBSON, if any; THE UNKNOWN HEIRS OF LETA GIBSON, if any; FIRST EUREKA SPRINGS BANK BRANCH OF 1ST NAT’L B & T, ROGERS BANK; The Tenants of 1152 CR 220, Eureka Springs, AR 72631, if any; and The Tenants of 1058 CR 220 Eureka Springs, AR 72631, if any, Defendants, the undersigned, as Commissioner of such Court, will offer for public sale to the highest bidder on the second floor of the Carroll County Courthouse, Western District, 44 S. Main Street, Eureka Springs, AR 72632, within the hours prescribed by law for judicial sales, on the 11th day of June, 2026 at 10:30 a.m., the following described real property situated in Carroll County, Western District, Arkansas:
TRACT B:
A part of Tract 1, Unit 3 of Moark View Estates, filed for record in Survey Book C at page 48 in the Office of the Circuit Clerk & Ex-Officio Recorder in and for the Western District, Carroll County, Arkansas ,and being more particularly described as follows: Commence at the Northwest corner of said Tract I for the Point of Beginning; thence South 88°42’54” East 314.48 feet, thence South 58°40’18” East 243.63 feet, thence South 10°23’10” East 319.40 feet to the centerline of a road, thence along said centerline North 88°24’57”West 158.39 feet, thence North 83°29’48” West 131.23 feet, thence leaving said centerline North 13°40’22” East 69.71 feet, thence North 3°40’03” West 289.80 feet, thence North 88°42’54” West 289.28 feet, thence North 0°05’49” West 65.23 feet to the Point of Beginning, containing 2.57 acres, more or less, shown as Tract B on Plat of Survey filed for record September 5, 2006, in Plat Cabinet G at Slide 389 in said recorder’s office. Also, this tract is a part of Lot 7 as shown on Plat of Survey prepared by Ozark Mountain Surveying dated October 6,1979.
Said property has a physical address of 1152 CR 220, Eureka Springs, AR 72631.
TERMS OF SALE: The purchaser will pay the full purchase price on the day of the sale or pay ten percent (10%) of the purchase price, non-refundable, with the balance due to the Commissioner, together with ten percent (10%) interest per annum from the date of the sale until fully paid, within three (3) months from the date of the sale. Prior to the commencement of bidding, any individual who shall desire to bid shall inform the Commissioner that they will pay the full purchase price in cash or he shall present a letter of credit or a bond as required by law to the Commissioner and shall receive pre-approval by the Commissioner to secure the payment of the remainder of the purchase price within three (3) months from the date of the sale. A lien shall be retained on the property sold to secure the payment of the purchase price until the balance is paid in full. The property shall be sold “as is”, “where is”, without warranty of any kind. The purchaser shall be responsible for the costs of the sale, as well as for any unpaid real estate taxes.
This sale is made subject to any and all stipulations made in the decretal Order filed of record on April 21, 2026. The Commissioner does not warrant title, boundary lines, taxes and or improvements, if any, on this property in Carroll County, Arkansas.
