NOTICE OF DEFAULT AND INTENTION TO SELL

NOTICE IS HEREBY GIVEN that on Wednesday, July 29, 2026, at or about 1:30 PM, the following real property will be sold and this statutory foreclosure sale will be held at the front door, inside the main entrance of the Garland County Courthouse, 501 Ouachita, Hot Springs, Arkansas, or the sale will be held in the place at said venue where foreclosure sales are customarily advertised and/or conducted, to the highest bidder for cash:
Part of the SE1/4 SW1/4 of Section 21 Township 2 South, Range 18 West, Garland County, Arkansas described as follows: Commence at the Northeast corner of said SE1/4 SW1/4; thence South 00 degrees 00 minutes 00 seconds West 186.00 feet to the Point of Beginning; thence South 00 degrees 00 minutes 00 seconds West 741.55 feet; thence North 78 degrees 00 minutes 00 seconds West 783.79 feet to a point on the East right of way of Cedar Creek Road; thence Northeasterly along said right of way to a point that is North 23 degrees 00 minutes 29 seconds East 620.98 feet from the last said point; thence North 89 degrees 14 minutes 00 seconds East 523.99 feet to the Point of Beginning. According to Survey by John C. Willias, Registered Professional Land Surveyor, dated December 20, 1995.
More Commonly Known As: 1240 Cedar Creek, Hot Springs, AR 71901.
On March 19, 2004, Gregory A. Suit and Patricia M. Suit, executed a security instrument in favor of Wells Fargo Home Mortgage, Inc., which was recorded on March 25, 2004, in Record Book 2385 at Page 0533 in the real estate records of Garland County, Arkansas and is now held by Federal Home Loan Mortgage Corporation as Trustee for Freddie Mac Seasoned Credit Risk Transfer Trust, Series 2018-2.
The default for which foreclosure is made is due to the failure of payment per the terms of the note and security instrument and is now wholly due. Mortgagee or Beneficiary is exercising its power of sale under Ark. Code Ann. Section 18-50-115 and such has directed Mickel Law Firm, P.A., as its Attorney-in-Fact or Trustee, to sell the property to satisfy said indebtedness. The party initiating this foreclosure can be contacted at or in care of its servicer: Shellpoint Mortgage Servicing, 55 Beattie Place, Suite 100, Greenville, SC 29601-2743, Phone (864) 312-4704.
This sale is subject to all matters shown on any applicable recorded plat or bill(s) of assurance; any restrictive covenants, easements, set back lines or encroachments; any unpaid and/or delinquent taxes or special assessments; any statutory redemption rights of any governmental entity; any prior liens or encumbrances as well as any priority created by a UCC or fixture filing; and, to any matter that an accurate survey of the property might disclose. This property is being sold “as is” with no representation as the condition of any structure(s) thereon or the accuracy of the above legal description.
