NOTICE OF DRAFT PERMIT
DECISION
FROM THE ARKANSAS
DEPARTMENT OF ENERGY AND ENVIRONMENT
In accordance with provisions of Arkansas Statute 8-4-203, public notice is hereby given that as of August 07, 2026 the Mining Program of the Division of Energy and Mineral Resources of the Arkansas Department of Energy and Environment announces its draft decision to issue an Open-Cut Mining Permit No. 0820-MN as requested by W.P. Adams, LLC Inc., 86 Yocum Street, Rogers. Arkansas 72756 for the mining operation located in the city of Springdale in Benton County Arkansas.
The Department has received the necessary documentation from W.P. Adams, LLC Inc.for the issuance of a new Open-Cut Mining Permit No. 0820-MN for the removal of red dirt at at 9653 Nations Drive, in Section 24 Township 18 North Range 31 West. The site will be mined with a total estimated affected area of 19 acres.
Any interested person may submit written comments concerning the Department’s draft decision within thirty (30) days of the publication of this notice. Any interested person may submit a request for a public hearing on the draft permit decision within thirty (30) days of the publication of this notice. The decision on whether to schedule a public hearing is at the Department’s discretion. If a hearing is scheduled, first class mail notice will be provided to the permit applicant and to all persons who submitted individual written requests for a hearing and who provided public comments on the record.
Written comments concerning the Department’s draft decision should be sent to: Ashlon Wasko, Mining Program Manager, Division of Energy and Mineral Resources, Arkansas Department of Energy and Environment, 3309 Phoenix, Fort Smith, Arkansas 72903 or by email to ashlon.wasko@arkansas.gov.
Additional information regarding the draft decision, including copies of the permit application and documents concerning the review process by the Department staff, can be made available for inspection and copying by contacting the Department’s Mining Program, Division of Energy and Mineral Resources in writing at the above address. There will be a charge to cover photocopying costs.
A final, written decision on this permit application will be issued by the Department after the close of the 30- day public comment period or after a public hearing if one is held. The final decision will include a response to each issue raised during the public comment period for this proposal and will include an explanation of the rationale for any technical requirements or standards involved in making the final decision. Any person with legal standing in this matter may appeal the Department’s final decision to the Arkansas Pollution Control and Ecology Commission. Appeals must be in writing, must be filed within 30 days of the Department’s final decision and must conform to all the requirements set forth in Regulation No. 8.
