COMMISSIONER’S SALE
NOTICE IS HEREBY GIVEN, that on the 8th day of October 2026, at 10:00 a.m., pursuant to the authority contained in the Judgment and Decree of Foreclosure of this Court dated and filed August 24, 2026, (the “Judgment & Decree”) in Case No. 49CV-26-22, the undersigned Commissioner appointed by the Court will offer for sale at public auction the following described property, together with any improvements thereon, situated in Montgomery County, Arkansas, to-wit: 407 Golden Road, Mount Ida, Arkansas 71957, more specifically described as follows:
Part of the NE 1/4 NE 1/4 Section 27, Township 2 South, Range 25 West, Montgomery County, Arkansas more particularly described as follows: Beginning at a found rebar, which is S 90 degrees 00’W520.65 feet from a found rebar with cap at the northeast corner of the NE 1/4 NE 1/4; thence running S 0 degrees 26’50”W 25.0 feet to a set spike nail with cap in the center of Golden Road; thence running along an existing driveway S 47 degrees 46’10”W 165.28 feet to a set spike nail with cap; thence leaving the driveway and running S 0 degrees 25’10”W 91.30 feet to a set rebar with cap; thence continuing S 0 degrees 25’10”W 35.0 feet to a set rebar with cap; thence running N 78 degrees 44’50”W 267.74 feet to a set rebar with cap; thence running N 0 degrees 38’30”E 55.0 feet to a set rebar with cap; thence continuing N 0 degrees 38’30”E 155.16 feet to a found rebar on the north line of the NE 1/4 NE 1/4 and in the center line of Golden Road; thence along the north line of the NE NE S 90 degrees 00’E 383.74 feet to the Point and Place of Beginning. Together with and being subject to an existing utility easement/driveway along the east line of the herein described property runnng from Golden Road southwesterly 280 feet, more or less, to access property lying to the South and all other matters of record. According to a survey by Robert W. Zickwolf dated April 10, 2006.
(collectively the “Property”).
The above-described Property shall be sold in the hallway directed in front of the Office of the Circuit Clerk at the Montgomery County Courthouse, 105 E Highway 270 East, Suite 10, Mount Ida, Montgomery County, Arkansas, where judicial foreclosure sales are regularly conducted at the date and time stated above. The terms of the foreclosure sale shall be for cash due to be paid by close of business on the day of sale or on credit, with interest, of not less than three (3) months nor more than six (6) months or on installments equivalent to no more than four (4) months’ credit on the whole, and Southern, or its assignee, shall have the right to credit bid up to the full amount of the judgment, interest, costs, and attorneys’ fees. In all sales on credit, except as to Southern or its assignee, the purchaser shall execute a bond, with good surety, to be approved by the person making the sale and by Southern, and the bond shall have the force of a judgment.
The sale shall be sale to the highest bidder, as set forth above, with prompt performance due. If on the date of sales prompt performance is not made, Southern shall be entitled, but not required, to enforce performance or to take the second highest bid (and so on until the Property is sold to a bidder) and all rights of Southern as to any non-performing bidders are reserved.
Upon confirmation of the sale herein ordered, the Montgomery County Commissioner will execute and deliver to the purchaser a Commissioner’s Deed conveying all right, title and interest in and to the respective Property sold.
You are invited to review the entire Judgment & Decree in the Montgomery County Circuit Court records in this case on file with the Clerk of the Court or by obtaining a copy from the undersigned counsel upon written request.
Any announcement made by Commissioner at the time of sale takes precedence over this Notice.
