TRUSTEE’S NOTICE OF DEFAULT AND INTENTION TO SELL
YOU MAY LOSE YOUR PROPERTY IF YOU DO NOT TAKE IMMEDIATE ACTION.
THIS IS AN ATTEMPT TO COLLECT A DEBT AND ANY INFORMATION OBTAINED WILL BE USED FOR SUCH PURPOSE.
On August 28, 2008, Patsy A. LaFollette and Lester C. LaFollette Jr. executed a Deed of Trust in favor of Alan E South, as Trustee for Urban Financial Group, which was recorded on September 4, 2008, as Instrument No. 08 005429 in the real property records of Boone County, Arkansas and is now held by Wilmington Savings Fund Society, FSB, not in its individual capacity but solely as Owner Trustee for Cascade Funding Mortgage Trust HB13. The party initiating foreclosure can be contacted at or in care of its servicer initiating foreclosure at: PHH Mortgage Corporation, P.O. Box 24738, West Palm Beach, FL 33416, at Telephone No. 1-800-449-8767; and
The default for which foreclosure is made is the borrower did not pay all property charges consisting of taxes, flood and hazard insurance premiums and special assessments in a timely manner as required by the terms of the Note and Security Instrument. Because of the failure to cure the default the indebtedness was accelerated, is now therefore wholly due and the Beneficiary has requested the property be sold to satisfy said indebtedness
On Wednesday, July 1, 2026 on or about 11:00 AM, the following described real property will be sold at the front door entrance of the Boone County Courthouse, 100 N. Main Street, Harrison, AR 72601, to the highest bidder for cash:
Exhibit A to the Mortgage made on August 28, 2008, by Lester C. LaFollette, Jr. and Patsy A. LaFollette, Husband and Wife (“Borrower”) to Urban Financial Group (“Lender”). The Property is located in the county of Boone, State of Arkansas, described as follows:
A part of the Southeast Quarter (SE 1/4) of the Southeast Quarter (SE 1/4) of Section Thirty (30), Township Twenty (20) North, Range Twenty-One (21) West, Boone County, Arkansas, more particularly described as:
Beginning at a found iron stake at the Southeast Corner of said Section 30, thence with South Line of said Section 30 North 89 degrees 13 minutes 07 seconds West 919.28 feet to the Center Line of County Road, thence leaving said South line of Section 30 and following said Center Line of County Road N 00 degrees 48 minutes 10 seconds E 149.09 feet, thence N 00 degrees 40 minutes 55 seconds W, 99.58 feet, thence leaving said Center Line of County Road S 89 degrees 30 minutes 00 seconds E 566.25 feet, thence S 04 degrees 00 minutes 58 seconds E 178.25 feet, thence N 87 degrees 56 minutes 17 seconds E 193.55 feet, thence N 04 degrees 12 minutes 23 seconds E 345.43 feet, thence S 89 degrees 30 minutes 00 seconds E 124.70 feet to the East Line of said Section 30, thence with said East Line S 00 degrees 31 minutes 01 seconds W 428.82 feet to the point of beginning.
More commonly known as 5024 Burlington Flat Road, Alpena, AR 72611.
There may be occupants that claim an interest in the real property herein based upon said occupancy.
The undersigned is the Substitute Trustee for the beneficiary and is acting on behalf of and with the consent of the beneficiary who is exercising its power of sale under Ark. Code Ann. Section 18-50-115 which implies a power of sale in every Deed of Trust of real property situated in this State that is duly acknowledged and recorded.
The sale is subject to all matters shown on any applicable recorded plat; any unpaid taxes; any restrictive covenants, easements, or setback lines that may be applicable; any statutory rights of redemption of any governmental agency, state or federal; any prior liens or encumbrances as well as any priority created by a fixture filing; and to any matter that an accurate survey of the premises might disclose.
The sale held pursuant to this Notice may be rescinded at the Substitute Trustee’s option at any time. The right is reserved to adjourn the day of the sale to another day, time and place certain without further publication, upon announcement at the time and place for the sale set forth above. The property is being sold “as is” with no representation as to its condition THE TERMS OF SALE ARE CASH THE DAY OF SALE AND ALL TRANSFER TAXES WILL BE THE RESPONSIBILITY OF THE PURCHASER. If the sale is set aside for any reason, the Purchaser at the sale shall be entitled only to a return of the deposit paid. The Purchaser shall have no further recourse against the Grantor, the Grantee, the Beneficiary or the Trustee.
