NOTICE OF DEFAULT AND INTENTION TO SELL
YOU MAY LOSE YOUR PROPERTY IF YOU DO NOT TAKE IMMEDIATE ACTION.
On August 7, 2017, Jordan B Qualls executed a security instrument conveying certain property therein described to Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for Stearns Lending, LLC, its successors and assigns; which was recorded August 7, 2017, Document No. L201706773; with subsequent modification recorded on
June 21, 2022, Document No. L202206876 in the real estate records of Baxter County, Arkansas.
A default has occurred due to the failure to make timely payments as required under the terms of the Note and indebtedness. Because of the failure to fully cure the default, the indebtedness was accelerated and is now wholly due. The mortgagee or beneficiary has requested the property be sold to satisfy said indebtedness, together with all fees and costs associated with these proceedings continuing to accrue, pursuant to the terms and conditions of the promissory note and security instrument. The mortgagee or beneficiary has complied with the conditions to exercise the power of sale as set for in ACA §18-50-103. On July 1, 2026, at or about 10:00 AM at the Baxter County Courthouse, Mountain Home, Arkansas, the real property described below will be sold to the highest bidder for the terms described:
TRACT ONE: A part of the NW 1/4 of the NE 1/4 of Section 9, Township 18 North, Range 12 West, Baxter County, Arkansas, described as follows: Starting at the NW corner of said NW 1/4 NE 1/4, run thence South 86°07’51” East for a distance of 400.32 feet to a 3/8 inch rebar and the point of beginning; thence South 86°10’06” East for a distance of 95.12 feet to a 3/8 inch rebar; thence South 03°50’35” West for a distance of 542.69 feet to a 3/8 inch rebar on the Northerly R/W line of State Highway No. 5; thence North 68°00’40” West for a distance of 100.00 feet along the Northerly R/W line to a 3/8 inch rebar; thence leaving R/W, run thence North 03°49’57” East for a distance of 511.53 feet to the point of beginning. TRACT TWO: A part of the NW 1/4 of the NE 1/4 of Section 9, Township 18 North, Range 12 West, Baxter County, Arkansas, described as follows: Begin at the NW corner of the NW 1/4 NE 1/4 and run thence South 86°08’32” East along the North line of said NW 1/4 NE 1/4 for a distance of 495.17 feet to the point of beginning for the tact herein described; thence South 03°50’35” West, parallel to the West line of said forty for a distance of 542.72 feet to the North R/W line of State Highway No. 5; thence South 68°00’11” East, along said R/W line for a distance of 170.55 feet; thence leaving said R/W line, run North 03°50’35” East for a distance of 595.82 feet along the West line of the Leon deKoning Tract, as described Warranty Deed, Instrument #6418-92, to the NW corner of said Tract; thence North 86°08’32” West for a distance of 162.06 feet to the point of beginning. EXCEPT any part of the above description lying East of Partney Drive. Being shown on a Survey by Slater Surveying & Mapping filed August 7, 1997 as Instrument #RS-297-97.

The Purchaser of said property shall pay the price bid with certified funds paid at the conclusion of the sale and shall assume all transfer taxes and recording fees. If the sale is rescinded for any reason, the purchaser shall be entitled to any funds paid and shall have no further recourse.
The property is sold “as is” and is subject to all matters shown on any applicable recorded plat; any unpaid taxes; any restrictive covenants, easements, or setback lines that may be applicable; any statutory rights of redemption of any governmental agency, state or federal; any prior liens or encumbrances as well as any priority created by a fixture filing; and to any matter that an accurate survey of the premises might disclose.
The right is reserved to adjourn the day of the sale to another day, time and place certain without further publication, upon announcement at the time and place for the sale set forth above. In the event of inclement weather, the right is reserved to postpone the sale to a date to be specified via mailed notices.
