NOTICE OF DEFAULT AND INTENTION TO SELL
YOU MAY LOSE YOUR PROPERTY IF YOU DO NOT TAKE IMMEDIATE ACTION.
On May 28, 2021, Ryan Joslin and Samantha Joslin executed a security instrument conveying certain property therein described to Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for Plains Commerce Bank, its successors and assigns; which was recorded May 28, 2021, Document No. 2021003706 and re-recorded on July 22, 2021, Document No. 2021005088 with subsequent modification recorded on September 5, 2024, Document No. 2024004715 in the real estate records of Boone County, Arkansas.
A default has occurred due to the failure to make timely payments as required under the terms of the Note and indebtedness. Because of the failure to fully cure the default, the indebtedness was accelerated and is now wholly due. The mortgagee or beneficiary has requested the property be sold to satisfy said indebtedness, together with all fees and costs associated with these proceedings continuing to accrue, pursuant to the terms and conditions of the promissory note and security instrument. The mortgagee or beneficiary has complied with the conditions to exercise the power of sale as set for in ACA §18-50-103. On July 8, 2026, at or about 11:00 AM at the Boone County Courthouse, Harrison, Arkansas, the real property described below will be sold to the highest bidder for the terms described:
Tract1: A part of the Southwest Quarter of the Southwest Quarter of Section Thirteen (13), Township Eighteen (18) North, Range 1 Twenty-One (21) West, Boone County, Arkansas, more particularly described as follows: Beginning at the Southeast corner of said forty; thence North 89 degrees 27 minutes 03 seconds West 741.98 feet; thence North 00 degrees minutes 49 seconds East 749.36 feet to the point of real beginning; thence North 89 degrees 24 minutes 02 seconds West 586.03 feet to the West line of said forty, said point being approximate center line of county road; thence with said forty line North 01 degree 12 minutes 51 seconds East 358.00 feet; thence leaving said forty line and following existing fence line South 86 degrees 06 minutes 33 seconds East 316.97 feet; thence North 01 degree 21 minutes 22 seconds East 228.16 feet to the North line of said forty, said point being approximate center line of State Highway No. 43; thence with said forty line South 89 degrees 27 minutes 03 seconds East 262.54 feet; thence leaving said forty line South 00 degrees 34 minutes 49 seconds West 568.15 feet to the point of real beginning. Tract 2: ALSO: An undivided 1/4th interest in the following described lands upon which the west is situated: A part of the SW 1/4 of the SW 1/4 of Section Thirteen (13), Township Eighteen (18) North, Range Twenty-One (21) West, Boone County, Arkansas, described as follows: Beginning at the NE corner of above forty run thence South 30 feet to the South side of Highway #43; thence West with said South line 544 feet to an iron state; thence South 74 1/2 feet to point of beginning; thence West 10 feet to an iron stake; thence South 20 feet to an iron state; thence East 20 feet to an iron stake; thence North 20 feet to an iron stake; thence West 10 feet to point of real beginning, ALSO: A right-of-way easement, with full rights of ingress and egress on a strip of land 10 feet wide running Westerly from this well tract 214 feet, the center of said being a water line buried underground, such real property having the address of 4615 Highway 43 South, Harrison, Arkansas 72601 (hereinafter referred to as the “Property”).

The Purchaser of said property shall pay the price bid with certified funds paid at the conclusion of the sale and shall assume all transfer taxes and recording fees. If the sale is rescinded for any reason, the purchaser shall be entitled to any funds paid and shall have no further recourse.
The property is sold “as is” and is subject to all matters shown on any applicable recorded plat; any unpaid taxes; any restrictive covenants, easements, or setback lines that may be applicable; any statutory rights of redemption of any governmental agency, state or federal; any prior liens or encumbrances as well as any priority created by a fixture filing; and to any matter that an accurate survey of the premises might disclose.
The right is reserved to adjourn the day of the sale to another day, time and place certain without further publication, upon announcement at the time and place for the sale set forth above. In the event of inclement weather, the right is reserved to postpone the sale to a date to be specified via mailed notices.
