NOTICE OF COMMISSIONER’S SALE
NOTICE IS HEREBY GIVEN, that in pursuance of the authority and directions in the Default Judgment and Decree of Foreclosure made and entered on the 27th day of April, 2026, in a certain cause of the Circuit Court of Sebastian County, Arkansas (Case No. 66FCV-26-446), then pending between Huntington National Bank, as successor by merger to Cadence Bank, Plaintiff, and Defendant Gary West, the undersigned, as Commissioner of said Court, will offer for sale at public venue to the highest bidder, in the main lobby of the Sebastian County Courthouse, located at 901 South B Street, Fort Smith, Arkansas 72901, within the hours prescribed by law for judicial sales, on the 14th day of July, 2026, beginning at 10:00 a.m., the following-described real estate located in Sebastian County, Arkansas, to-wit:
Lots 29 and 30, Block 1, Westminster Addition to the City of Fort Smith, Sebastian County, Arkansas, as shown on Plat Record.
(the “Real Property”).
TERMS OF SALE: The sale is “as is where is” without any warranty whatsoever. The purchaser will be required to pay ten percent (10%) of the successful bid in cash, non-refundable, before 3:00 p.m. on the day of the sale, and post a bond acceptable to Huntington National Bank and the Commissioner with approved security to secure payment of the purchase price, and liens shall be retained on said lands to secure the purchase price; provided that if Huntington National Bank becomes the purchaser at the sale for an amount not in excess of the judgment and costs herein, in lieu of giving bond, it may credit the amount of the bid less the costs of this proceeding, including the Commissioner’s fee, upon the judgment herein rendered, at the time of the confirmation of such sale, which credit shall be in extinguishment of this judgment to the extent of such credit; and provided, further, that if the amount bid by Huntington National Bank shall exceed the amount of judgment and costs, bond shall be required only for the excess.
